It is your responsibility to ensure the final payment clears. Any payment stopped or due to a closed account will result in a lawsuit filed immediately and added court fees.

Cancellation Terms: *

I wish to CANCEL my draft membership at Total Body Gym. It requires a FULL TWO-MONTH notice. I will make sure the monies are in the bank for the final draft(s). ADDITIONAL fees can incur my final draft under terms of membership & going rate fees. The access (key) tag is property of Total Body Gym, and is due under these terms and agreements, per my confirmation letter. By retaining the access (key) tag, it is implied consent that I wish to continue my membership at a monthly cash price and charge, and a new notice of cancellation is required. I will receive notice of when my last draft will occur and when the access tag is due. I acknowledge that I can drop the card in the INSIDE of the KEY TAG Box, but until it is in the confirmed possession of Total Body Gym, I am responsible. I acknowledge that it is MY responsibility to ensure that the card is working when received and that my account is satisfactory, or I can receive additional fees. I acknowledge I can and will be held legally responsible for any legal fees, court costs, and past due balance, should my account be placed in collections for past due balances. By completing electronic forms online through mybodygym.com or any other respective sites; emailing a “cancellation notice” to cancel@mybodygym.com and or but not limited to PRINTING and mailing through the postal carrier, these terms all bound me, the member, to the terms and conditions enforced by Total Body Gym cancellation process.

Legal Agreement: *

Total Body Gym will lawfully collect all fines, extra fees, and surcharges allowed by law through the agreed terms of service. All collection negotiations are conducted before the lawsuit is filed. You will receive an invoice or a notice of intent to file, which you may then dispute charges. Failure to respond, it is implied you accept all charges listed, and a lawsuit will be registered to collect payment. Any time after the litigation process begins or a lawsuit is filed, you will have Additional Legal Fees applied to your account. Abrupt stop payments and closed draft accounts are an immediate breach in terms of membership, & will file suit immediately upon receiving the notification or refusal of payment. I understand by submitting this request and NOT turn in my access (key) tag, I can be held liable for additional monthly membership prices because it is my implied consent to continue my membership as a cash-paying customer.
